We don't have "Freedom of Religion" in this country, we have "Freedom of Religions and practices acceptable to the Christian majority". If your faith or practices aren't acceptable to the Christian majority they make laws against it and claim it is a law of "general applicability". (Liberty Bell -

As I continued to correspond with Ed one question would constantly come up in my mind and that "Is this real?" Ed Forchion has filed a Civil Rights Lawsuit at the Federal Courthouse in Camden NJ Forchion Vs Judge Morley - 06CV623(JBS) alleging that the state of New Jersey has taken him away from his child because of the political issue he supports (the legalization of marijuana) and the religion he follows - Rastafari. Forchion claims that as a Rastafarian he is punished for his psyletizing about his faith by having his child taken from him. At first I thought not in America, we have freedom of speech and religion!
As time went on, I began to get a clearer picture, and was astounded by what I saw.
Ed Forchion isn't just an activist, and he isn't just a black legalize it advocate. He's a Rastafarian which is one of the 1,500 recognized religions in this country.
And this is precisely why he isn't allowed to see his child, he told me.
"If I was just a legalizer I would get one response, but that's not how I am viewed. I am viewed as this bigmouth Negro with this radical weird black religion – "Rastafari" - that use’s marijuana," Forchion said. Do you think race plays a part? Yes, a big part - image if I were white? Do you think I'd get attacked like I do by the police, do you think groups like Norml would ignore the abuse's of Government directed at me for saying "legalize It"/
"Here in NJ there are
several politicians (Sen. Joseph
Vitale, D-Middlesex, Sen. Nicholas Scutari, D-Union, State Assemblyman Reed Gusciora
(D-Princeton) and State Assemblyman Michael Carroll ( How in I regard the current marijuana laws in the US as ridiculous Christian superstitions made into law. Similar to how 500 hundred years ago people who claimed the world was round or not the center of the universe as the Christian leaders did they were beheaded or burned at the stake. Many a person was killed by the Christians for telling the truth. Today to speak the truth about marijuana is dangerous as well. I thank GOD they don’t burn you at the stake or behead you anymore otherwise I’d have long ago been a headless crispy critter but I’ve been jailed, denied fair trials and had my child taken from me for publicly speaking the truth about marijuana the sacrament of my faith. All this I regard as nothing but Christian Persecution.
In 1994, cites Forchion, he started to call himself a Rastafarian.
Also in 1994 he met Linda Holden the mother of his child "Ajanea" who is being kept away from him because he’s not A Christian. Linda the mother keeps Forchion away from their child, by using the courts black male stereotypes, bigotry, and discrimination and out right religious intolerance against him, Forchion says. I admit I ruined my relationship with Linda; I cheated on her in her mind. Me, I don’t endorse this one man one women concept that Christians believe in. So I don’t view what I did a “cheating” even though I do acknowledge I didn’t fully inform Linda of my views on this. I wanted to have a child, she wanted to have a child and we planned and succeeded in doing so. Then she stole my child with the help of the Christian Judge's on the Bench.
"She has every right to be angry," Forchion told me, "But (my child) is still (my child)". She had every right to end our relationship if that is what she wanted but not that of my child.
40% of mothers reported that they had interfered with the father's visitation to punish their ex-spouse, according to Stanford Braver a contributor to American Journal of Orthopsychiatry.
Forchion is understandably
pessimistic or realistic about the situation, but has still taken the chance
of continued persecution by giving this interview in the hope that somewhere,
someone has an answer to his problem. Maybe a father’s rights lawyer will
take the case on he said. In the meantime the case is before the U.S.
District Court in The First Amendment exists so as to promote debate on
issues of public importance. In this case, the advocacy of the legalization
of marijuana is a legitimate political position in this country. The
Libertarian Party, whose presidential candidate received over 380,000 votes
in the 2000 election, advocates the legalization of drugs. Libertarian Party
website at http://www.lp.org/issues/relegalize.html
and http://www.lp.org/campaigns/pres/.
Many elected public officials have
called for a liberalization of the nation's drug laws. Simply put,
Plaintiff's place in this debate will do nothing to harm a public that is
already itself debating the current state of our nation's drug laws. I was actually mad at the Governments Drug war policies and how for
voicing my opinion the Government took my child and the state arrested me for
that! For voicing my opinion on
"I've already lost, I've
missed seeing my (child) grow up," Forchion said. For eleven years this
scorned women has kept me from my child. Nothing will get me back the lost
kinship and bonding with my child. She knew I wasn’t a Christian when she met
me and I never realized you had to be a Christian to be a father in
When Forchion met Linda Holden the mother of his second child, his religion was not a problem, Forchion says. But since the two broke up, and since she went on to become more active in her own religious life (She became a born-again Christian), she has used Forchion's religious preference against him in the Burlington County New Jersey family court.
I’ve actually obtained several
court ordered visitations but "She flat out ignores them (the court
orders) and the judges side with her by not ever holding her accountable,
never has she been punished for ignoring the court orders," Forchion
told me. Forchion says that his child's mother has used basic ideas (marijuana)
about his religion to cast him in an unflattering light. While here in
"She's come to court and said, 'He (Forchion) has this weird religion!'," said Forchion,"She only does this to appeal to the bigotry of the judges on bench." And it has worked.
As he cites in his sight www.njweedman.com and from what he's told me, Rastafarianism is at its core a more Judaic religion that incorporates old rituals, rituals used by real Hebrews and other predominantly African communities would use. That isn't to say that Rastafarianism is a Christian-religion; because it is not. Rastafarianism might make reference to the Bible, but Ed Forchion, at least, does not believe in the divinity of Christ.
"I believe that Jesus was a very godly man, I believe he was a prophet, like Bob Marley. He (Bob Marley) wasn't just a singer," said Forchion. His songs were sermons.
"The way that I've chosen to accept God in this Christian-country is illegal because of the sacrament of the faith is marijuana," Ed told me. While the Christians say we have freedom of religion in this country, they also outlaw the sacraments and practices of hundreds of religions with laws they claim are religiously neutral or laws of General applicability.
It becomes painfully clear when talking to Ed that his life has been rift with religion.
"My parents they were born Christians," Forchion said, "I went to church with my grandmother every week until I was about 12. I was born and raised in a Baptist family, I have several uncles who are Baptist ministers and at every family function it is clear I come from a traditional black Baptist family. I was also taught to read, and loved history. My parents were into black history and self-esteem. My mother was called an Angela Davis wan-na be. "My mother wore a big afro, the whole nine yards. She had black history lessons in our house for the neighborhood kids before black history was in school!" Ed told me. It was his mother who bought Ed his first set of Encyclopedia, and for Forchion this was the beginning of his journey away from the Christian religion.
"I learned about religion from church, and from the history in the books and the history didn't match up (with what I was learning in church)," Forchion said, "I learned thru what I read that for about 350 years the institution of slavery was used to Christianize Africans." The Christianization of Africans was used as a justification for slavery. In my mind slavery had ended over a hundred years ago and I didn’t have to follow the Whiteman’s religion. As a child I learned the
teachings of Marcus Garvey who said; "If
the white man has the image of a white GOD, let him worship his GOD as he
desires. If the yellow man's GOD is of his own race let him worship his GOD
as he sees fit. We as Negroes have found a new ideal. Whilst our GOD has
no color, yet it is human to see everything through your own spectacles, and
since the white people have seen their GOD through white spectacles, we have
only now started our (late though it maybe) to see our GOD through our own
spectacles. The GOD of ISAAC and the GOD of Jacob let HIM exist for the race
that believes in the GOD of Isaac and the GOD of Ethiopia, the everlasting
GOD - GOD the father, GOD the Son and GOD the HOLY GHOST, the One GOD of all
ages. That is the GOD in whom we believe, but we shall worship HIM through
the spectacles of
Like a lot of young
African-Americans at the time, Forchion turned to Islam for
consolation. “I rejected Christianity and I wanted to become a
Muslim," Forchion told me. Forchion begged his parents to allow him to
go to an Islamic Temple in Yet, the most significant
moment in his religious life occurred at the age of 12 in 1976 when the movie
ROOTS first hit But as Forchion explains, the
Black Community at that time, and still, has strong chains bonding it to
Christianity, and his family strongly urged him to get back on the Christian
Bandwagon. Forchion would later be forced to go to a
In 1982 Forchion graduated for
"I tried Christianity, I tried Islam and neither of them worked for me," Forchion said.
In 1984 Forchion quit College joined the regular active military, and enlisted in both the Marines and the Army for several years. During that time he married (1988) his childhood friend, Pam Wright, a catholic and the two had a child “Chanel”.
Forchion was honorably discharged in 1990 for the US Army. This marriage ended on New Years Eve 1994. It wasn't until the two broke apart that Forchion's feelings about religion changed once again. My Marriage with Pam broke up because she kept having abortions, I viewed them as murder and she viewed them as a medical procedure. Irreconcilable differences would be a under statement. I viewed her as defective. In 1993 she had two abortions. My new years resolutions of 1994 was to find me a new women, one that wanted to raise children not murder them. I ran away for a while to
There I had an experience I can only describe as a religious experience. I meet what I thought at the time were neighbors. "There was three Jamaican guys and they were smoking spiffs on the steps next to my apartment. They engaged me in a good conversation. One of them, the oldest looking one who at first wasn't talking started talking about religion - RASTAFARI and I started telling him my problems," Ed later told me that these Jamaicans he found out later did not actually live anywhere in Tucson. No one knew who they were. To this day he believes he met the biblical three wisemen.
"I felt I had a religious experience," Forchion said, "I was considering suicide and for some reason this particular day everything seemed to mean something." The old dread told me souls of my children were in New Jersey and I wasn't going to find peace until I found them.
The Jamaicans told Forchion that
what he needed wasn't in
On But he is not, as his child's mother has said, according to Forchion, a Christian. Linda has waged an 11 year Christian crusade to keep him from Ajanea because he doesn’t accept the Whiteman’s version of Christianity as his religion. In 1998 Forchion married Janice Bailey, had another child his son KING and took on Janice’s 4 other kids as his own. So while Forchion is the father of 3 of his own children and 4 step children he is prevented from being a father to his daughter Ajanea because he’s not a Christian. Linda objects to his views and beliefs. The courts who you would think would protect this fathers parental rights and the child’s right to have a father haven’t because he follows a non Christian religion.
