As I said, before I was polygamous, but never before
had I made such a mess. A clash of Religion's. As I said before,
Linda was my NJ girlfriend. Then I screwed up. I got what I prayed for. Two babie's. I believe I got what I prayed for. I got two women
pregnant at the same time. Linda and Janice. I met both Linda and
Janice about the same time, sometime in the spring of (94).
Immediatedly after I broke up with my wife, I went looking for another.
The only requirement I really was seeking was she had to be willing to
have my child, and be a non-smoker (tobacco), and accept my use of
marijuana. While Linda and I developed a relationship, Janice and
I remained friends, basically phone friends. We talked a lot but didn't
see much of each other. We never had sex. When I was in NJ I was at
Linda's, the rest of the time I was driving, back and forth coast 2
coast. I'd lay over in Arizona on most trips west, December was like a
little buddy, she was just 21 years old and basically she just stayed
at my apartment in Az I was more of a sugar daddy to her than a
boyfriend.
Linda has a real beef. I left her with the inpression she was the only one. Although I told her how my womanizing ways had helped to ruin my marriage. I mis-lead her to believe I was trying to remain faithful. I never told her about anything of December. Linda and I had a good relationship, We never even argued. I thought she was a little strange but I also thought that was cute about her. But we didn't have sex often. Why, I don't really know, she just didn't enjoy sex, (MAYBE IT WAS ME) many women are like this. I think we only had sex when she felt it was time to conceive. Which was alright to me, like I said before I just wanted a baby. One weekend in Oct (94) I was at her home in NJ for the whole weekend no sex, on monday after she went to work, I decided to go to lunch with Janice. We ended up having dessert at her house. It was the first time we had sex and we conceived. "JAH" saw to that. (Daeja). The next weekend Linda told me she was pregnant. 6 weeks later, in Dec.94. Janice told me she was pregnant too. It was a nightmare, I caused it, I prayed for it. I couldn't tell Linda what I had done, I told Janice. Through-out Linda's pregnancy I told her nothing of Janice. I just couldn't. It was amazing the same Dr.s, the same hospital Memorial Mt Holly NJ, in fact the babies where born in the same room (204) just 5 weeks apart. When Linda found out (Pam my first wife told her) she went ballistic. First she told me I'd have to stay with her and forget about my other child (Daeja). I told her I couldn't do that, so she promised me I'd never see our daughter again and has tried everything within her powers and a few lies too, to keep me from my child. I thought the court would prevent this, but was I mistaken.( CLICK HERE ). She has had some success after I was arrested for the big marijuana charge in Nov. 97, she has sought to keeps me from my child. Basically she's a scorned women getting even. She keeping my child from me. I agree I screwed up with her but that is my child. I'm her father. She has come to court telling some of the biggest lie's I have ever heard about myself. She's repeatedly filed false charges against me, she's abusing the restraining order laws. Using them to keep me from my daughter. She even went to court saying she had no idea I smoked marijuana- what a lie, every single person who knows me knows I've smoked marijuana since I was a teenager. I know the day we conceived Ajanea I was high. What the Burlington County Family Court has allowed to happen to my relationship with my daughter Ajanea should be criminal. Father have no rights in family court. Linda from the time we broke up has kept me from my daughter, for three years I repeatedly went to court to gain a reasonable visitation. I never did. Then when I ran for Office on the Legalize Marijuana Party slogan my limited visitations where taken. I haven't seen my daughter in over a year. I believe this is a violation of my first amendment rights not only was I punished for talking of legalizing marijuana, (expressing my thoughts) but for the religion I so chose. RASTAFARI.-- Janice and I on the other hand have gotten married (Sept 19th, 1998), and had another child my only son "KING". I've tried my best to remain faithful since the disaster of (95), but it's not in me. I off and on keep in touch with December, I even brought her to NJ for a little while, Janice has met her, before we were married, they were cordial. But Janice has told me no more of the polygamy. I love Janice now, so I will try, that's why I married her. She has dealt with my shit the best, and truely wants to see us live out our lives together. I really hope we live out our lives together, I sometimes joke with her that I may someday challenge the polygamy laws by marrying some-one else also, but only if she gets along with them. If my wife accepted me taking a second wife, that would be our decision not the governments, this is just another example of how Christians leaders/lawmakers have made Christian religious practice's law. Adultery, or the one man one women concept is a Christian religious concept, if a person like me who isn't a Christian choose's to have more than one wife, I believe I shouldn't be arrested. The laws making that a illegal act are violations of the 1st amendment, despite the constitutions guarantee of separation of church and state and the free exercise clause. Hopefully I won't end up in prison for most of my life for challenging the marijuana laws, I'd have rather challenged the polygamy laws but the Marijuana laws have ruined me now so currently I'm not looking to find a additional wife---!!!! I have my hands full trying to stay free. |

In 1996 because of the contacts I was having with
people of similar views on marijuana I decided to start two groups I
hoped would lead the way in the marijuana reform movement in New
Jersey. I bought a house June 96 in Chesilhurst, New Jersey and started
my New Jersey movement, and maintained my apartment in Az.
The SJCBC- South Jersey Cannabis Buyers club, and the LMP - Legalize Marijuana Party. "(1) The South Jersey Cannabis Buyers Club - The active wing- supplying patients with their medicine. -This was what I had tried to start in late 1996 before my accident. After marijuana was legalized for medical use in both Arizona and California, in Nov. 96. This was to be similar to the one's I had observed in Arizona and California. I was hoping to become a Dennis Perron (California) or a Marc Emery (Britsh Columbia).-- (2) The Legalize Marijuana Party- I was hoping this could be the political wing of the marijuana reform movement here in New Jersey-I was hoping others would volunteer to become candidate's. I thought maybe it would spread nationally as a protest party. I so far am the only candidate, but I ran for two office's -Congress 1998: NJ 1st Congressional District.- and Camden County Freeholder 98- This year (1999) I'm again on the Nov ballot for CamCo. Freeholder, and also for NJ State Assembly. I didn't, and don't expect to win but I did think I would get many more vote's than I did get. The hundreds of thousands of potheads in this area just didn't show up. Regardless I'm going to say what I believe about marijuana all the way till the verdict is read at my trial."
Everything was going fine until I was a passenger in a car accident on
Jan. 5, 1997. This accident has changed my whole life. I suffered a
couple of herniated disc, as well as a bulging disc. I was in extreme
pain for months. I couldn't drive my truck anymore. So I could no
longer transport the medicine from the growers in Arizona and Mexico.
The SJ cannabis buyers club was idle. I had also received a warning
from a couple of police officer's that although I may really feel I'm
doing a good, I was breaking the law and they were aware of my
intentions. With that knowledge and my not driving coast 2 coast

On August 2, 1997, (r) Governor Whitman signed into law, a law she had pushed hard for and supported. This new law made marijuana possession a 1st degree felony like rape murder, or felony assault punishable by 20 years in prison. I knew nothing of this What a FUCKING BITCH ! As other states criminalized or legalized for medical use this Bitch increase's the penalties. This is just another example of stupid politicians. Republican. The war on drugs can't be won ever. There will never be zero drugs. This country will either be free or drug free not both. But idiot politicians (Especially republicans) every election year run on lies that the "WAR on DRUGS" is being won by the Government They make promise's and pledges to increase drug possession penalties. They say that will lower the amount of drugs on the street. Not so. It just fills jails. Which by the way also have drugs in them. I was the first charged under this new law. ALL NEW LAWS
ARE SUBJECT TO CONSTITUTIONAL CHALLENGE'S
On Nov. 21st, 1997 a package didn't arrive as planned via federal express as was planned. I was visiting December. The package was for the AIDS group in Philly. The individuals who took over shipping marijuana for the patients didn't have a truck like I did so they used federal express. I didn't ship this way, (but many do), because of my fear that something like this may happen I never did. This was all arranged between them, I wasn't around. I hadn't transported anything in close to a year, since my accident. ( DR REPORT ) When the package didn't arrive on Saturday, they panicked. The buyers, the owners and the individuals who were transporting it. Yes, they called me, just to let me know what happened. When I heard about it I told them all to leave it alone. One of them I was real tight with so I knew he wasn't going to forget it. He said, "Federal express said the package missed the plane", I told him it probably is in the hands of the Police. Since it wasn't mine, I wasn't to worried about it. I was worried about him. I warned them not to get it. They tried anyway. I couldn't help but want to see what happened so I came early and watched from across the street. It was delivered by a Police Officer (Camden County Investigator Mark Nickols) dressed as a Federal express agent. Gilligan- (click here) Bob Denver was recently arrested in the same way. I knew it. While I was sitting across the street reading the paper and listening to Howard Stern, Jerome Keys and two white guy's drove up. About 2 minutes before the Federal Express van pulled up. I knew Jerome was a cop or a NARC. Jerome, or ROME as everyone around here called him, grew up in Sicklerville, we have plenty of mutual friends. In fact we were at the same Bachelor party, just a few of months before when a mutual friend got married. At this point I called on my cell phone and told them Jerome was outside. I watched from a distance as other police officers prepared to raid the building where the shipment was delivered. Suddenly (my brother) bolts from the building in his van. I could have just stayed right where I was at at I wouldn't have been arrested at all that day. I couldn't resist the temptation to get in Jerome's way as he started chasing after him. I get between his van and the police who start to follow, for a minute or so. I tried to slow Jerome down, eventually they go around me, pointing there guns out the window cursing me out. After a couple of miles he is pulled over. I stop a couple hundred yards ahead and watch as he's arrested, it was a nightmare. Then the guy's that were in Jerome's Jeep, come running up to me with their guns drawn yelling lay down, lay down. I'm arrested too. Again I could have avoided arrest if I had just kept going.
At the time I didn't think I would be charged with the possession
charges because I never entered the property, and I certainly didn't
have possession. I was under the assumption maybe for the interference
I'd get a ticket, but I knew the weed wasn't mine. In fact I never
entered the parameters of the search warrant. The search warrant was
specifically for Berg Labs, I never stepped on the premise's. In fact I
don't even believe my car stop and initial arrest was justified, I
wasn't ticketed for anything. At first I believed I was charged just to
sweat me into cooperating- (RATTING). My running for office and all
that secured my indictment. I was told if I hadn't made so much noise
maybe my charges would have gonna Immediately upon being arrested I was read my miranda rights. In fact I was read them twice. I even signed a miranda card. I declined to make any statements, and asked for a lawyer. Matt Portello to be specific. Mr Portello was representing me on another matter at the time. I was placed in a office for a while, a couple of Camden County Investigators kept coming in asking me if I wanted to cooperate, I declined. They seemed to know a few past things about me, I assumed they had a rat. They told me, we were the first individuals arrested and charged under this new crime bill that made marijuana a first degree felony. I repeatedly talked about the absurdness of arresting people for marijuana. Mark Nickols kept asking me If I would cooperate, he specifically stated If I delivered the package to XXXXXX, or XXXXXX that day we would walk. They were under the impression the weed was going to a couple local drug dealers they had real hard ons for. I'm not going to name them now-here-, I'll save it for trial, but I knew them both, neither of them sold weed, they sold coke. They have been selling coke in and around Sicklerville for years (to people who wanted it), what the Camden County Prosecutors Office was asking me to do was immoral, set these guys up because they couldn't catch them legally. I don't do or condone cocaine use, but to me, still to each his own. They had nothing to do with this package as far as I knew. Plenty of people are jailed just like that everyday. Set up by the cops. Lie's created by cops jail people everyday. That day I could have agreed to lie and maybe I would have walked that day too. Up to that point, I took the whole arrest as a thumped up attempt to get me to talk, then a Gloucester County Investigator walked in asking me about a weed field they found the year before, in the woods of Glassboro. I had about 50 plants growing in two patches of woods I thought was safe. One day when I went to check on them several were missing, it looked like someone had just taken them. I didn't want to lose them all, so I removed every one of them, from one patch that day and left the other. I was afraid to come back to it. Two days later a couple of friends of mine told me they saw the police looking thru the woods. I wasn't sure what all he knew so I again asked for a lawyer, I thought I might be charged with that. (Cultivating).
Then came the shocker Mark Nichols told me bail was set at $100,000.oo
- I was floored, "for what you didn't catch me with anything", I said.
They responded CONSPIRACY. There was no conspiracy, by me. Knowledge of

The school zone charge was later dropped, that was just added for
newspaper sensationalism. It is obvious to anyone who reads the
discovery, or the facts that I didn't posses anything. So ultimately I

Immediately after I was released from Camden County
jail (two days later) I needed a joint. My back was killing me. Camden
County Jail is worst than the county dog shelter, we were stacked 4 to
a disgusting room designed for two. I was stuck on the floor. I was
stiff as shit, when I got out I walked just a couple of blocks from the
jail and bought a bag of weed off the street, first time in years I was
forced to do that. From my jail cell window I could see the open
black-market, providing what citizens want. The catch is thugs and
criminals run this operation, with scavengers and thieves constantly
trying to accost the customers. The ultimate fear is not any of them
though, it's the police. The Police cause more harm, & fear than
any problems the criminal or drug ever could, and it's legal. I
actually was more afraid then, going to that corner, than when I was
arrested.
From the time I was arrested, I said," I want a trial". Sometime in the year (2000) I will probably go to trial. I met with Matt Portello on that Friday, he told me the case would cost me at least $25,000 and could go as high as $50,000. I didn't have it so I made a appointment with the Public Defenders Office. Kevin Walshe was the lawyer assigned to my case, as soon as I started telling him the tactic's and motions I wanted to present to the court as part of my defense, he refused to hear them. He ridiculed them and made it clear he had no intention on presenting my defense, at trial. The second time I went to see him, his boss Deputy Public Defender Micheal Friedman flat out said he wasn't going to present my planed defense and no-one in his office will be allowed to. (He repeated this refusal in a letter to Judge freeman on May 20th, 1999) They refused to defend me in the way I legally wished to be defended. So I was forced to ask the Judge to allow me to represent myself, since the PD refuse's to prepare my case for trial. Since then I have found two case's which I tried to show him as example's of my proposed defense's being utilized in other case's. ( US-vs- Bauer ) -- and more recently US-Guam vs Ras Benny ( Guam Case ) - The first is case which the 9th circuit of appeals ruled religious use of marijuana can be used at trial. The second is a case where a motion to dismiss based on the religious use of marijuana is used successfully. The case was dismissed. There are many, many more but the PUBLIC DEFENDERS OFFICE refuse's to prepare my constitutionally guaranteed defense. The PDO is contributing to my 5th, 6th, and 7th amendment rights violations. Yet as of now (August 29th-1999) the public defender is officially my counsel. The Public defenders office's is just another part of the Prosecutors office anyway if you ask me. One puts you in jail hard, the other tries to soften your landing, put your still in jail. At this time I can't afford a lawyer who will. I want too challenge the law, I say," Marijuana is not a schedule 1 drug". It has plenty of medical use's. I as a RASTAFARIAN believe marijuana is good, a sacrament not the dangerous drug the government tries to make it out to be. I feel the free exercise clause of the first amendment should protect RASTAFARIAN anyway. Just as christian have exceptions for certain alcohol laws, rasta's should also have exemptions for marijuana laws. This new law I'm charged under doesn't reflect that. In addition to this I believe it is within my constitutional right to utilize whatever medicine I want to put in my body, I have been using marijuana for years as my natural medicine. In the Roe vs. Wade decision the Supreme Court ruled the Government has no business being in a women's body based on the fourth amendment. Why doesn't this apply to marijuana user's. Why does the government have the right to tell me what to put in my body, or the bodies of the millions of others who use marijuana for there own medical needs. In fact just this year on March 18th, 1999 the Institute of Medicine released a report that supports the medical use's of marijuana. - IOM- REPORT (Medical Marijuana)
For some reason I already knew that all new laws are subject to constitutional challenge's. Quickly after my arrest I decide that I'm going to challenge the constitutionality of this new law, with a jury. "Jury nullification of law," as it is sometimes
called, is a traditional American right defended by the Founding
Fathers. Those Patriots intended the jury to serve as one of the tests
a law must pass before it assumes enough popular
authority to be enforced. Thus the Constitution provides five separate
tribunals with veto power – representatives, senate, executive, judges
and the jury – that each enactment of law
must pass before it gains the authority to punish those who choose to
violate it. Thomas Jefferson said, "I consider trial by jury as the
only anchor yet imagined by man, by which a government can be held to
the principles of its constitution."
