UNDER A  WATCHFUL EYE

August 11, 2003 - Ed Forchion, better known as "the Weedman," loves publicity almost as much as he loves marijuana. Last Monday, (AUGUST 4th, ) he was arrested during a protest outside the U.S. Attorney's Office in Newark, and he called a variety of newspapers in case they missed it.

Normally, this would not be worthy of note; Forchion has a history of arrests during similar pro-marijuana legalization protests. But on Monday, the incident had an unusually prominent witness - counsel to the U.S. Attorney, Paula Dow. "She was very nice," says Forchion, who didn't know who she was at the time.

The theme of the protest was that U.S. Attorney Christopher Christie is a "hypocrite" because he hasn't investigated the state officials who jailed Forchion after he made legalization protests during his post-conviction supervision last year. Forchion won a habeas suit in federal district court that ruled that jailing illegal.

"I met him for a short period," Dow confirms. "I wanted to find out if anything was happening improperly . . . I didn't see anything."

Forchion, who says he will plead not guilty to charges of creating a disturbance, soliciting and vending, and noncomformity with signs and directions, argues that he has a First Amendment right to hold a sign and distribute fliers outside the federal building. His court date is Oct. 30; he faces fines totaling $150.

I've now been arrested on August 4th, 11th, & 18th 2003 for standing on "WALNUT STREET" (a Newark N.J. city street) - infront of the Federal Building holding a sign expressing my dis-pleasure with a Government Official. ("AND I'M ARRESTED"!) I now have two court dates "Oct 30th, and Nov. 28th" at the MLK Federal District Courthouse in Newark, next door to the very same federal building I'm protesting at! The HYPOCRACY of standing trial for peacefully protesting in the Martin Luther King courthouse hasn't escaped me either!

I plan on filing suit in against these ASSHOLES!

WHY I'M COMPLIANING

BACKGROUND INFO:

On April 3rd, 2002 I was released from the State of New Jersey prison system and paroled into the state (ISP) Intensive Supervision Program but quickly found out the state officials planned to use the ISP as the Inmate Silence Program. I was ordered not to talk about marijuana and not to talk to the press both of which I considered "illegal-unconstitutional" directives and disregarded them. I repeatedly warned these state officials that even convicted persons have the RIGHT to FREE SPEECH to no avail. 

On May 27th, 2002 I gave two interviews to a couple of local newspapers the Burlington County Times and the Trentonian. My (ISP) officer punished me for this by having me "illegally-jailed" in the Burlington County Jail for 5 days! (June 6th-June10th, 2002). This infuriated me to no end!

So I contacted Peter Christopher of www.nextplayvideo.com and asked him to help me make 3 commercials questioning the "WAR ON DRUGS" and extolling "FREEDOM of SPEECH". (SEE COMMERCIALS HERE). After they were completed I contracted with "COMCAST CABLE COMPANY" to air these "POLITICAL ADVERTISEMENTS" in 5 S.Jersey counties. The "POLITICAL ADS" were to air on August 17th, 2002.  I provided copies to numerous local papers and gave interviews about the contents. On August 15th, 2002 The TRENTONIAN wrote about the ads in a story titled: "WEEDMAN TAKES CAUSE TO THE AIR".

That same night COMCAST CONTACTED me and told me they were yanking the ads!! On August 17th, 2002 THE TRENTONIAN wrote about the ads being cancelled in a story titled "WEEDMAN ADS YANKED".

On August 19th, 2002 I was arrested by (ISP) for making the commercials and for maintaining my website: www.njweedman.com. My ISP officers said the ads were advocating criminal activity and attempted to send me back to prison as a "PAROLE VIOLATOR". I filed a "WRIT OF HABEAS CORPUS" with the U.S. DISTRICT COURT of NEW JERSEY in Camden (NJ) claiming I was illegally imprisoned in violation of my RIGHT to "FREE SPEECH". I took 5 months but on Jan. 24th, 2003 JUDGE IRENAS ruled in my favor, citing I was unconstitutionally imprisoned for exercising my "RIGHT to FREE SPEECH". Ever since my release I've been attempting to file FEDERAL CRIMINAL charges against the state officials who imprisoned me. The U.S. Attorney's Office has ignored my attempts and my hand written complaints. "This isn't the first time the U.S. Attorney or the N.J. THE POLITICS OF POT
 

On August 19th, 2002 New Jersey State Officials “jailed” me for producing 3 anti-drug war commercials and maintaining a website: WWW.NJWEEDMAN.COM – This imprisonment lasted for over 5 months until U.S. District Court (Camden) Judge Irenas ordered the State to release me ruling my imprisonment was “unconstitutional”. My then repeated attempts to file FEDERAL CHARGES against these state officials who “illegally” imprisoned me in violation of my right to FREE SPEECH have been ignored by U.S. ATTORNEY CHRISTIE. 

Yet, on July 17th, 2003 after New Hanover Mayor Patrick Mallory was arraigned at the Federal Courthouse in TRENTON - U.S. Attorney Christie held a news conference on the courthouse steps. Christie said, “Here we have entrenched, arrogant public officials scheming and self-dealing at the public’s expense”. Corruption runs north to south in New Jersey, and we will continue to do our part to stamp it out in all regions of the state”. He then went on to say, “We are looking everywhere, wherever it is we will root it out, prosecute and send it to jail”. 

 I have a major complaint. It may not be corruption but what happened to me was definitely a crime, committed by these state officials under “color of law”! These New Jersey state officials deliberately violated my “civil rights”, and it is a federal crime per: s20 of the Criminal Code, 18 U.S.C. s52,18U.S.C.A. s52  but my complaint(s) to this same U.S. Attorney has fallen on deaf ears because I’m not of the right “political persuasions”. I’m an AFRICAN-AMERICAN who represents the Legalize Marijuana Party and openly calls for the politically incorrect – “END OF THE WAR ON DRUGS”.  

s20 of the Criminal Code, 18 U.S.C. s52,18U.S.C.A. section 52  say’s:  "Whoever-, under color of any law, statute, ordinance, regulation, or custom, 'willfully' subjects, or causes to be subject, any inhabitant of any state, territory, or district to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution and the laws of the United States, or to  different punishments, pains, or penalties, on account of such inhabitant being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined not more than $1000.oo, or imprisoned not more than one year, or both".

s 37, 18 U.S.C.A. Statute 88 s 19 18 U.S.C.A. section 51- "If two or more persons conspire to injure, oppress, threaten or intimidate any citizen in the free exercise or enjoyment of any right or privilege secured to him by the U.S. Constitution or laws of the UNITED STATES, or because of his having so exercised the same, or if two or more persons go in disguise on the highway or on the premises of another, with intent to prevent or hinder his free exercise or enjoyment of any a RIGHT or privilege so secured they shall be fined not more than $5000 and imprisoned not more than ten years, and shall, moreover, be thereafter ineligible to any office, or place of honor, profit, or trust created by the U.S. Constitution or laws of the UNITED STATES".

Could you imagine being thrown in jail for exercising your first amendment right(s) to “FREEDOM OF SPEECH” and “POLITICAL EXPRESSION”? 

 

MESSAGE TO MR. CHRISTIE:

YOU ARE YOU A HYPOCRITE?

 

 

On August 18th, 2003 I was roughed up by the Federal Police for again holding a sign calling U.S. Attorney Christie A HYPOCRITE"! I was advised it was going to get worst every week if I insisted on coming back every-week. I was also advised by (ISP) that arrests are violations and I could be "again" violated! But as many already know I truely believe in the squeeky wheel gets the oil!

 

This has been no different.

Update on these letters: They were bogus, sent to me by the U.S. Attorney to get me to stop coming to his office but were NOT sent to the FBI as was stated on the letters.

CASE DIS-MISSED

 

On Thursday 1/29 a hearing was held in the Martin Luther King Federal Courthouse in Newark, N.J. before Judge Maritone. This case was totally dismissed. Although I knew the case never had merit and was strictly a illegal, unconstitutional attempt to silence me on the part of the U.S. Attorney’s Office. – I refused to agree to any stipulation that the “federal police” had probable cause to arrest me on any of the dates (Aug. 4,11, and 18th 2003). I announced that I would be filing a BIVENS lawsuit against the U.S. Attorney and the Federal Police. – I am currently asking lawyers if they are willing to take this case on on a contingency basis. If anyone knows a lawyer in the Philadelphia-New York corridor who is willing to talk to me about this case please forward this page to them and have them contact me.
