Ed "njweedman" Forchion moments before he enters Congressman Rob Andrews Office, using his medicine, natural "MARIJUANA" 
 

On April 27, 1998 I walked  into the Haddon Heights, New Jersey Congressional office of (D) Robert Andrews. I am a medical user of marijuana. As well as a follower of Rastafari.  The month before I had written to Mr. Andrews when I heard that HR 1732 "the medical marijuana bill" was to be voted on the following month (May 98). I wanted him to know that I wanted him to vote "yes". The letter he responded back with was so full of ignorance.( Read-his letter below ). He responded that he was going to vote against it and then went on to state some of the reasons why. I was shocked that a member of congress seemed to believe some of the myths and falsehoods about marijuana that are commonly spread by propaganda groups like "DARE", the "Partnership of a drug free america" or the Drug Czar himself, (Captain Idiot-commonly known as:) General MCcaffey with his ONDCP commercials. Everything he said either wasn't true or was a description of legal drugs (alcohol). I personally thought what a idiot!

   For several days I called trying to catch him in his office to speak with him about the reasons he was opposed to it. Finally this day he was in. I went to his office to demonstrate the effectiveness of marijuana on my  CHRONIC PAIN CONDITION   as well as the "ASTHMA" I had been born with. I smoked a whole joint in his office, and handed the roach to his aide, who then flushed it down the toilet. The whole time I was smoking it Mr. Andrews just watched in what appeared to be amazement. It was hard to tell though because he has that duffus look all the time.  His only comment was "go home and smoke it" to which I replied "it's still illegal for me to (self medicate with marijuana) smoke at home too. That's why you should vote yes to the marijuana bill before you next month". One of his aide's started screaming his secretary had asthma-I said, "so do I, this is also one of the reasons I use marijuana". 

     Because I then refused to leave the police were called, when they walked in the door they smelled the sweet aroma of high grade marijuana. I was treated very nicely, but was removed from the building. The police let me go because they said, "they had no evidence." Most of the time when police smell marijuana they go berserk, but of course they were trying to keep Mr. Andrews office out of it, so they released me. -- "Think about it, just say you were stopped by the police on the street, if they smell it chance's are your going to be at least draged down to the police station."



             Safest Place in America to Smoke a Joint!

   Since I openly smoke a joint in Rob's office, without being arrested, I came to the conclusion that his office was a safe place to smoke a joint. So one hour later I came back this time I called the police myself from the pay phone outside, I told the 911 operator that I was sick and was going to use my medicine -which I told her was marijuana. I really was in a lot of pain that day. I then went into his office again. And this time I held onto the roach until the police arrived. I was arrested, I gave the officer's the evidence myself.. 

   Well here it is over a year later and each time trial is to begin the prosecutor tells the Judge that he doesn't have the evidence, and asks for a continuance. I think it's bullshit! But I'm not going to ask for a dismissal. The next scheduled date is-25 May 99. If I'm convicted what I want to do is appeal it as far as I can, that was part of the purpose of this protest in the first place.

My Legal Defense's
1. Medical: marijuana is a natural medicine.-it doesn't fit the description of a (CDS) schedule 1 drug. According to the law: 

 - (a).The desciption say's (marijuana) has no medical value in the USA . 
 - (b).Must be addictive 

According to Scientific Fact
Marijuana has been proven to have plenty of medical use's, it's use's are recognized in over 30 state's including the state of New Jersey. Several Juristictions have legalized for medical reasons- Arizona, Alaska, California, Oregon, Washington State, Washington DC- * Nevada, Colorado,- also did but will require new votes in Nov. 2000 The March 1999 - IOM report proves marijuana isn't addictive.

*- I freely chose to use safe natural marijuana as my medicine in following the teachings of my faith & becuase it is flat-out safer than the legally prescibed drugs I prefer not to use. - This is again protected by the: 
NJ Constitution- Article I paragraph 1.(SAFETY)



2. Religious: I am a believer of Rastafari.-Marijuana use is part of our belief.  The present marijuana laws interfere with my religious freedoms as guaranteed, by the First amendment's ""Free exercise clause" the Religous restoration act of 1993. The Religious Liberties Act.
And the N.J.Constitution.



3.-Expression:- Just as flag burning, is protected as a first amendment expression of speech. I feel my burning a joint in Congressman Rob Andrews office was just the same.

On Oct. 12th I was arrested in Stradford NJ. One of the charges I was arrested for was for failing to show in Haddon Heights NJ, there's no jury there so why should I show anyway. The warrant and arrest were for the Demonstration at Rob Andrews office. (above) 
 

   I had a valid Arizona lic.#, my New Jersey lic I had surrendered them to the state of Arizona. as per the CDL regulations. One of the reasons I surrendered it was because of New Jersey's profiling and Insurance surcharges which are punishments handed out by street cops. A police officer's bogus ticket can ruin you and you have no right to a jury in New Jersey's municipal court system. 

  I was in compliance with Federal Regulations. The State of New Jersey as a way of punishing me for my outspokeness on the marijuana issue has attacked not only my ability to speak freely in public but also to travel. My right to travel was taking in spite of the federal regulations I was in compliance with. I have maintained my Arizona issued lic while I remain in New Jersey on bail, for charges stemming from my Nov. 24, 1997 arrest . Apparently On the 7th of July 1999 the state of New Jersey's request to Arizon that my licences be rescinded was approved unbeknownst to me.
   I had insurance and etc.etc. but wasn't given the oppurtunity to present it. - I guess I may have been exceeding the speed limit, I was stopped in a speed trap where municipalities lower the speed limit from 45 to 25 and township police officer's wait to collect revenue. The officer say's I was going 44mph. 

    I have no lawyer to fight these charges. This is one of the reason's I filed the 17 million dollar Lawsuit. The state and it's agents have issued numerous bogus citations just to cause harm to myself. All because of what I've been saying.
LEGALIZE MARIJUANA. I didn't have these troubles before I opened my mouth.

The New Jersey Weedman has struck again. 

Political pot activist, and congressional candidate, Edward Forchion, a.k.a NJWEEDMAN, filed an appeal Wednesday on marijuana possession convictions stemming from two instances in 1998 during which he smoked a joint in the Camden office of Congressman Rob Andrews. 

Forchion, a practicing Rastafarian who shocked onlookers in March when he lit another doobie in the chambers of the New Jersey Assembly, argued in his brief that the convictions violate his religious rights and also deny him a critical treatment for a variety of medical afflictions. 

"The marijuana laws of New Jersey are based on lies," declared Forchion, who is running on the Legalize Marijuana Party ticket for New Jersey’s First Congressional District seat, during a visit to The Trentonian. 

"Everyone in prison for marijuana use is there because of lies. They are political prisoners," he added. 

The pot-smoking incidents related to his current convictions took place on April 27 and 28, 1998, according to Forchion’s appeal document. 

The document states that "on or about April 2, 1998" Defendant Edward Robert Forchion wrote a letter to Congressman Rob Andrews asking him to support the passage of legislation pending before Congress that would have legalized marijuana use for medical purposes. 

Reportedly angered by Andrews’ response in another letter, the document states, Forchion visited the congressman’s office on April 27, 1998, smoked a joint to demonstrate its medicinal benefits and then left the office. An hour later he returned to Andrews’ office and smoked another joint. He was subsequently arrested. 

The next day, the document states, Forchion went to The Democratic Party headquarters in Cherry Hill, where he smoked another joint to demonstrate the plant’s power. He was also promptly arrested after this incident. 

On February 23 and 29, 2000, Forchion was convicted for marijuana possession for these arrests. 

Carrying a massive file of medical reports, Forchion argued Wednesday that marijuana smoke was crucial for treating his afflictions of asthma, depression, chronic pain and trauma-induced epilepsy. 

In his appeal brief, Forchion writes "It is NJWEEDMAN’s contention that he has a fundamental right under the United States Constitution, and the New Jersey Constitution to make rational choices regarding his medical care, and that the state may not limit his choices for effective medical treatment without demonstrating a compelling need and employing a means that it narrowly tailored to accomplish its objective." 

"I could have kept my marijuana smoking private, like most people do. But because I’m honest and forthright about what I do, I’m now in legal trouble," Forchion declared. 

A hearing on the issue has been scheduled for August 28.
