On Tuesday May 11th, 2005 NJWEEDMAN was attacked by New Jersey State Trooper #5773 Robert Rasinsky, who’s known as “ROWDY ROB” amongst his trooper buddies. This was an unprovoked attacked that will surely be “white-washed” as was done in a similar attack on NJWEEDMAN by NJ State Trooper Patrick Thornton #5411 in 1999.

 

NJWEEDMAN was going to the state capital building on legitimate business in connection to his campaign for the office of Governor. He was specifically going to PRESS ROW a public section in the state building reserved for numerous state newspapers and media outlets to deliver a campaign PRESS RELEASE. He has gone to PRESS ROW dozens of times delivering press releases without incident but on this day as he entered the building he was stopped by “ROWDY ROB” who took offense that he was wearing a shirt with a marijuana leaf and the statement “LEGALIZE CANNABIS”. Trooper Rasinsky doesn’t normally work the front door and claimed to be unfamiliar with WEEDMAN. “ROWDY ROB” falsely claimed the building was not open to the public and refused to allow weedman to pass. When weedman insisted that the building was public and he had every right as a state citizen to enter this building. TROOPER RASINSKY hand-cuffed the WEEDMAN behind his back and began to choked him by placing both hands around the front of weedman’s neck. As WEEDMAN struggled against this “ATTACK” the duo was joined by another un-named trooper who ended the melee with a swift kick to NJWEEDMAN groin. –

 

Immediately after this attack the New Jersey State Troopers went into CYA (COVER YOU ASS) mode and claimed NJWEEDMAN was being dis-orderly and the building was not open to the public. WEEDMAN was charged with (1) resisting arrest,(2) disorderly conduct and (3) trespassing.


This is the shirt I was attacked for wearing!



The marijuana leaf is the symbol of my political party, no different than the Elephant or the Donkey of the Republican and Democratic party. I have a right to express my political allegiance and views. Could you imagine the press reports of this attack had it happened to a Democrat or Republican? I did nothing wrong! I was simply expressing myself while on the way to the press. I can't believe the press has failed to report this story accurately!!! I WAS ATTACKED!!!

NJ Weedman faces trespassing charges

TRENTON - Edward Forchion, the Pemberton Township resident and marijuana proponent better known by the self-ascribed moniker NJ Weedman, was arrested inside the State House building yesterday afternoon on his way to tell news reporters about his intention to run for governor, officials said.

Forchion, 40, of Browns Mills, never got past the New Jersey State Police troopers who guard the State House complex. Troopers arrested Forchion after he refused to leave the building after being told press row was not open to the public, state police spokesman Sgt. Gerald Lewis said.

He was charged with resisting, defiant trespass and improper behavior.

 

Although the state police say press row is not a publicly accessible area, State House-based reporters say that members of the public routinely visit the area to pitch stories.

Forchion's fight to legalize marijuana on Rastafarian religious grounds has taken him to several arenas in the past decade, from running for a number of political offices, including Congress, to firing up marijuana joints in public.

In March 2000, Forchion smoked marijuana in the State House's Assembly chambers during a session and was arrested by state troopers.

Forchion was being held last night on $40,000 bail at the Trenton Police Department lockup.

TRENTON – A self-proclaimed  pro-legalization marijuana activist known as NJWEEDMAN was arrested by New Jersey state police yesterday at the statehouse after he refused to leave the building when his request to go to the press area was denied.

 

Robert Edward “weedman” Forchion, 40, of Pemberton, was arrested at 2:30 p.m. yesterday and charged with dis-orderly conduct, resisting arrest and defiant trespass, said Sgt. Gerald Lewis.

 

“He actually came to the front entrance, signed in and asked to be allowed to go to press row to handout fliers,” Lewis said,

 

“Troopers told him that the public is not allowed to access the area. The officers asked him if they could call someone to come and meet him and he refused.”

 

Forchion became boisterous and refused to leave, officials said.

 

Officers arrested him, took him to headquarters, and processed him. He is presently being lockedup on $40,000 bail, according to family members.

 

Forchion a Rastafarian by faith, is no stranger to run-ins with the law.

In 1997 he was convicted of possessing more than 40 pounds of marijuana and served 17 months of a 10 year prison sentence. Forchion did not return several phone calls yesterday for comment.

Weedman busted - but not for 'that'


If there's an election afoot in the state of New Jersey, you can be sure Ed Forchion wants in.

Last week, Forchion, a.k.a. NJWeedman, who advocates legalizing marijuana, said he wants to be the state's next governor. On Wednesday, the Weedman, who last ran against Rep. Jim Saxton on the U.S. Marijuana Party ticket, went to the Statehouse in Trenton to hand out campaign flyers on press row.

But state police said Forchion became "boisterous" when told that flyers could not be distributed in the Statehouse.

When he refused to leave, Forchion was arrested and charged with being a disorderly person, defiant trespassing, and resisting arrest, said Sgt. Gerald Lewis, a state police spokesman.

(Question: How does one "defiantly trespass" on state property?)

Weedman, a regular at the Statehouse, tells a slightly different story. He said the trooper was a new guy who did not like the candidate's pro-reefer T-shirt. Weedman said that when he defended the shirt as protected free speech, he was cuffed and kicked.

Either way, back to jail Weedman went.

While I was still in the Trenton City lock-up, members of the State Police went to my website and entered this entree on my guest-book. The State Police's computer crime lab could tell exactly who posted this "entree" if they wanted but to them it's a joke.

I don't consider my being attacked, and kicked in the balls for attempting to talk to the press to be a joke.

I have something for the state police that I'm sure won't be considered a JOKE!


I'm constantly being victimized by state officials for voicing my opinions, these two law enforcement officials are supposed to protect my Constitutional rights as well. Yet, because I choose a Religion that is illegal and voice a Political opinion (legalization) they don't like I've been jailed even by them. Peter Harvey the New Jersey Attorney General fought to keep me in jail for making "Political ad's" in 2002 and the U.S. Attorney had me arrested three times in 2003 for calling him a "HYPOCRITE".

Forchion, who is running for governor as head of the Legalize Marijuana Party of South Jersey, was wearing a t-shirt emblazoned with the slogan "Legalize Cannabis," and that was apparently too much for State Trooper Robert Rasinsky, who, according to Forchion, "took offense" at the shirt, told him he could not enter the building, then arrested him when he insisted he could.

According to Forchion, it is common practice for interested parties to distribute press releases to the capitol's press row. "I've gone to press row dozens of times delivering press releases without incident," he said in a statement released after his arrest.
Forchion's account of press row's accessibility was backed up by the Times of Trenton. "Although the state police say press row is not a publicly accessible area, State House-based reporters say that members of the public routinely visit the area to pitch stories," the paper reported in its story on the incident.

According to Forchion, Trooper Rasinsky "falsely claimed the building was not open to the public and refused to allow me to pass. When I insisted that the building was public and I had every right as a state citizen to enter this building, Trooper Rasinsky hand-cuffed me behind my back and began to choke me by placing both hands around the front of my neck. As I struggled against this attack, the struggle was joined by another unnamed trooper who ended the melee with a swift kick to my groin."

State troopers, unsurprisingly, had a different take on events. The troopers are in "cover your ass" mode, over what amounted to arresting him because they didn't like his t-shirt, Forchion said. Run-ins with the law over marijuana and free speech are nothing new to the 40-year-old Forchion. After being arrested with more than 40 pounds of pot in 1997, Forchion got seriously active, running for a number of political offices. In March 2000, he was arrested for smoking marijuana in the State Assembly chambers during a session. After serving 17 months in prison over the 1997 bust, Forchion was released on parole in 2002, but then jailed for five months by parole authorities after producing a marijuana reform TV commercial that never ran. It took a federal judge to set him free that time.

Forchion isn't going to let another hassle at the hands of the authorities stop him, but he has expressed displeasure at the lack of support from other drug reformers. "This is just another example of that fact that I'm just a nigger with a big mouth to many white authorities," he said. "Things like this don't happen to white activists. There is no white activist in the country who has been jailed simply for wearing a t-shirt with his or her political opinion on it, yet the mainstream reform groups say virtually nothing about my constant abuse at the hands of state officials. I can believe this happened to me because I'm just another nigger to many," he said, adding that he just may move to have his name legally changed to "Just a Nigger."

Forchion certainly can't be accused of mincing words -- his campaign slogan this year is "Fuck the Law, Smoke it Anyway."

Weedman has right to speak

Pemberton Township resident Robert Edward Forchion, a perennial New Jersey political candidate, has a message many people might not want to hear. Forchion, who prefers the moniker NJ Weedman, advocates legalizing marijuana use.

We do not endorse using illegal drugs, but we do stand behind a person's right to say he does.

Forchion has an undeniable right to state his claim as long as he doesn't break the law he's contesting. That right has been upheld by the court, but it continues to lead to confrontations with authorities.

On May 11, Forchion was arrested for trespassing at the State House in Trenton. He had attempted to pass out campaign fliers in the press offices at the state building. It is something he has done in the past. It also was not an unusual request, as candidates and others seeking the public's attention often visit the press offices.

But when Forchion showed up wearing a campaign T-shirt with a message about legalizing marijuana, a state police officer told him the press area was off limits.

What happened next will likely be settled in a court, where so many of Forchion's collisions with authorities end. The only thing both sides agree on is that Forchion was charged with defiant trespass, resisting arrest and other offenses.

It is unclear how a person can trespass in a public building during a time when it is open to the public. It is equally difficult to understand how Forchion can be denied access to an area in that public building that is frequented by the public.

Forchion might not appear to be the kind of person the First Amendment was written to protect. His in-your-face push for legalizing marijuana juts out from the American mainstream. But he is just the person for whom the amendment's free-speech rights were written - someone expressing a view the majority dislikes.

Silencing people such as Forchion will, in the end, make it harder for anyone to speak up. Silence, not the Forchions in America, poses a threat to our way of life


ON JUNE 7th, I will return to the State-House. After I turn in
my ballot petitions to the department of elections I will attempt to inform the press on press row, via a hand delivered PRESS RELEASE.
Will I be arrested?

I was not arrested. I was met outside the State Capitol building by Detective Sgt. Dangle who informed me he would escort me through-out my "VISIT" to the State-House. I came with a cameraman to record the events. I did deliver my "PRESS RELEASE" and was in and out of the building in less than 10 minutes. Which is probably 5 minutes more than I would have taken on May 11th, had Trooper Rasinsky not been a JACK-ASS!

Letter to the Editor,

 

 

DO BLACKS TRULY HAVE FREEDOM of SPEECH and RELIGION?

 

I know the answer to this question, "no". To many white authorities we are simply NIGGERS. I was recently given another example of this at the New Jersey State-House by Trooper Rasinsky #5773.

 

On May 11th, 2005 I was attacked by Trooper Rasinsky and arrested for attempting to wear a Political shirt with the slogan “CANNABIS LEGALIZE IT” on the front and the Legalize Marijuana Party on the back into the state-house. Something I do regularly. I am a candidate for the office of the Governor and was simply going to PRESS ROW at the State-House to deliver a press release to the state’s media outlets. Something I’ve done dozens of times over the years. The state police claim I was being boisterous, dis-orderly and lunged at Trooper Rasinsky. (Outright lie) Once again the state has shown me that I’m a second class citizen not enjoying the same rights as our white citizens. I did nothing wrong, what I was doing is protected speech. I simply openly express my political opinions all the time when in public. No-one has to agree with me but I can’t be attacked by Government officials for doing it. This is what the first amendment protects us against.

 

While most Americans freely enjoy these RIGHTS, African Americans only enjoy them at the approval of white Government officials. As long as African Americans say things acceptable to white society they are free to speak, likewise as long as African Americans follow religions acceptable to white society they have freedom of religion. You see I know that Speech, Religion, practices and beliefs that white society doesn’t approve of is not allowed because I say and practice them regularly.

 

There have been a few public examples of this recently here in New Jersey. Remember Amiri Barika the state poet laureate who had the nerve to openly question the Governments version of the 911 “HOAX”. Yeah, I too do not believe the Government version of the events of 911. He was vilified by white politicians and his job was eliminated. Or more recently secretary of state Regena Thomas who in a speech to south Jersey school children told children of the RACIST history of this country. (Ironicly I was assaulted outside her office.) She is currently being vilified by our white politicians and there is a movement to eliminate her position as well!!! These aren’t isolated instances here in New Jersey. Look what recently happened in Philadelphia after Mayor Street said to a 2002 NAACP audience, “that the brothers are in charge now”. The Federal Government launched a criminal investigation into his administration under the guise of corruption but I know the reason.

 

This is what I face daily. I openly don’t believe the white man’s religion (CHRISTIANITY). It’s a fact that whites thru the 350 year CHRISTIAN institution of slavery forced blacks to be Christians, most still follow the religion of our slavers. I don’t, I choose my own I’m a RASTAFARIAN by faith (which is protected under freedom of religion) and speak out against America’s Christian inspired racist war on drugs. For this I’m constantly attacked by Government officials and occasionally by ordinary do-gooder born-again types. 50 years ago a non-Christian "NIGGER” - like me would have been lynched. 150 years ago during slavery I'm the type of "nigger" who would have had is feet cut off or his tongue cut out. TODAY our racist Government officials are more politically correct, so I won’t be lynched. Instead in today’s society I'm the type of "NIGGER" who is jailed to shut me up by state officials. There is a clear attempt to prevented me from expressing my views or making me so uncomfortable I’d stop. This is exactly the reason why I was jailed in 2002 for 5 months for making political commercials that questioned our Christian Governments WAR ON DRUGS. This is why COMCAST won’t air my commercial. This is why the Judge’s on the Burlington County Superior court have persecuted me over the years.

 

This is what happened last week (May 11th, 2005) I was attacked by a New Jersey State Trooper for wearing a Political T-Shirt that expressed my political opinion “LEGALIZE CANNABIS”. Trooper Rasinsky recognized me as one of those type of “NIGGERS” and attacked me when I questioned his truthfulness: he lied and said the statehouse building wasn’t open to the public. Then got mad when I told him to show me a piece of paper that say’s that. (How dare this NIGGER question me!) When he couldn’t produce any he told me to leave the building or I’d be placed under arrest. I told him to arrest me than because I wasn’t leaving the building I have every right to enter. I turned around and handed him my hands. I did not resist until he kicked me and tried to chock me. Any claim that I resisted arrest is a State Police lie! What I resisted was his attempts to brutalize me. My name “ain’t” Rodney King the next time I’m attacked by a State Trooper I’m going to defend myself more like Joan Chesimard.

THE CRIMINAL CASE BEGINS

Since Trooper Rasinsky charged me with a 3rd degree indictable offense the case is to be heard at the Superior Court level. where to my advantage I'm entitled to envoke my 6th Amendment Right to a Jury Trial of my peers. My fear is that the "shitsystem" will attempt to "WHITE-WASH" this incident and have it heard at the municipal court level where a "WHITE LAWYER" appointed by the local Democratic Party to serve as a Judge will railroad me into a conviction to protect this WHITE TROOPER. "A WHITE-WASH"

My first court date is set for May 19th, 2005 at the Mercer County Superior Court. I filed this motion in an attempt at keeping the case at the Superior Court level, where I have the right to a JURY TRIAL. Will a Judge have the Balls to hear this motion or will it be allowed to be ignored ADMINISTRATIVELY so no JUDGE will have to leave his/her filthy finger prints on this WHITE-WASH".

(LETTER: MERCER COUNTY SUPERIOR COURT ). THE POLITICAL "WHITE-WASH" BEGINS. TRENTON -- Edward Robert Forchion, the "Weedman," had a chance to wiggle off the hook of law enforcement yesterday and go back to his new home in California a free man.

But he refused. And now he’s still in the clutches of the law.

Facing charges of trespassing and disorderly conduct as the result of a May 11, 2005, disagreement with State Trooper Robert Rasinski at the main entrance to the New Jersey State House, Forchion was all set to go to trial yesterday before Trenton Municipal Judge Lawson R. McElroy.

Forchion said his lawyer, Lee Wearing, was offered a deal prior to the trial’s start.

Assistant Municipal Prosecutor Bertha L. Scott offered to drop the state charges, if Weedman would plead guilty to a violation of the city nuisance ordinance, and pay a small fine.

Then Forchion could take his tractor-trailer and go back home to California, to which he’d moved recently to start a new (and legal) marijuana-intense life.

"I told them no," said Forchion. "I told them I hadn’t done anything wrong, and that I wanted to go to trial."

So to trial they went.

The contentions are fairly simple: Last summer, the Weedman was a candidate for governor, and he said he’d show up at the State House, resplendent in his duds -- "I Love My Country," his shirt yesterday said, "But I Fear My Government" -- and distribute his press releases along press row.

But that day, Forchion testified, he was stopped by Rasinski at the main entrance off West State Street, and told he needed an appointment to get into the State House. Which had never happened before.

Rasinski testified he’d advised the defendant that "the public was not allowed to roam freely around the State House, that he’d have to make an appointment ... and he became very boisterous, and demanded to be allowed in, that this was a violation of his rights.

"He tried to bypass me; I told him to stop. He said, ‘You’re going to have to arrest me,’ and became loud and disruptive. He said, ‘I don’t need an appointment with anyone; I’m allowed to go up there -- it’s my right!’"

After Weedman was in handcuffs, Rasinski said, "he lunged toward me, striking me in my left shoulder, and I had to get assistance from another trooper to take him into custody."

Forchion testified it was "ridiculous" that he would lunge at the armed trooper while in handcuffs, and denied that.

He said he’s been pamphleting press row for 10 years, and he’d been allowed up there 30 times without interference or harassment.

He charged Rasinski "told me to get on the ground, and I told him ‘No.’ He attempted to do a leg sweep, kicking through to knock me off my feet, but he just kicked me. I stepped back. He couldn’t knock me down, because he wasn’t big enough. This was just a way to humiliate me and abuse his power.

"After he kicked me, I did start yelling," Forchion testified. "He grabbed my neck and hair. Another trooper ran up and kicked me good in the groin, and I went down -- and they pulled me back up!

"Three or four other officers hurried over, and said, ‘What’d you do, Weedman?’ and I said, ‘He flipped out, lost his mind over my shirt!’ "

And so it went, until at 3 p.m., Judge McElroy made a continuation of the trial until mid-May.

Weedman’s witness list contains the names of two state troopers and a woman clerk at the State House entrance, along with two reporters, including The Trentonian’s Charles Webster.

Meanwhile, on March 28, Forchion goes to court in Mount Holly on charges of refusing to pay child support.
